Did you know that one out of every 25 families in the United States has a child who has been adopted? Though the United States’ adoption system encourages individuals to consider the option of adopting, there is a thorough screening process involved in placing a child with the right family. This means that there are multiple steps that need to be taken over the course of a handful of months in order for you to successfully adopt a child. This process can be made easier if you decide to hire an adoption attorney. At Koontz Law, we have experience in helping countless couples to build the family that they have always dreamed of through the legal journey that is adoption.

What Is Adoption?

Adoption is defined as the action of legally taking custody of another individual's child. When a person over the age of 18 years old adopts a minor who is under the age of 18, he/she is legally agreeing to raise that child as their own, despite that child not being their biological child. In order for the adoption to go through, the potential guardian must be screened. Some of the most common ways that people seeking to adopt are screened include:

A home study is completed, where a licensed social worker will visit the potential parent(s) home.

The individual(s) must agree to a background check.

Interviews may be conducted with the potential parent(s) family members in order to see whether or not the individual(s) can adopt a minor.

A psychological examination will be conducted.

Other potential medical tests may be performed.

Needed legal advice and as soon as I called I felt that I would be well taken care of. Very professional, personable, and supportive. I got the answers I needed quickly and will definitely be my go to in the future!

Adoption in North Carolina

Adoption attorneys are professional, experienced attorneys who help to facilitate the adoption process. It is significant to hire an adoption attorney when going through such a process because the adoption must be completed under North Carolina state law and federal laws. In addition, adoption lawyers function to act as a potential adoptive parent’s advocate. This can be helpful so that adoptive parents can get their questions answered, and have a guide and support system throughout the process. There are many rules when it comes to adopting in North Carolina, including but not limited to:

Eligibility. In order for a potential adoptive parent to successfully adopt a minor, he/she must be at least 18 years of age. As previously mentioned, they must go through a number of tests, including but not limited to the ones mentioned above. He/she must also be a resident of the state of North Carolina for a minimum of 90 days.

Consent. If the adoptee is 12 years of age or older, they must give their consent.

Different types. There are two types of adoption: closed adoption and open adoption. If the birth parents do not want to be found by their biological child in the future, they can opt for a closed adoption. If there can be communication between the two parties, it will be open adoption.
