Easements.  An easement is a legal right that allows a person to use someone else’s land for a specific purpose. An easement is most commonly created by an explicit grant in a deed or other recorded instrument, such as a survey. Easements generally exist out of convenience or necessity for neighboring property owners. Easement disputes most commonly occur when there is no clear documentation creating the easement with a well drafted description, location, purpose, and any restrictions or terms included. 

Petition to Partition. You may fall underneath this category if:


  • We can’t agree on how to divide the property
  • Not Married but we own property together
  • When people who are not married own real estate with one another, conflicts regarding the property may arise.  When conflicts of this nature do arise, and the people cannot agree on a resolution.  North Carolina law states that a cotenant of a parcel of real property may petition the court to partition the property physically, or by sale, in the alternative. There are different factors for determining how the property dispute will be resolved and it is important to consult with an experienced attorney on these matters. 

Drafting Leases and Contracts. Drafting your own contracts or leases are a recipe for disputes, defalcations, disaster, and ultimately, wildly expensive litigation.
